Civil Litigation

Civil litigation constitutes a substantial portion of the practice of our firm. Our litigation department provides clients with expertise in a broad spectrum of civil practice, including the management, trial and appeal of cases in all Florida and Federal Courts. In the course of litigation, we consider all legal options and work toward resolving every matter in a manner most beneficial to our clients.

When disputes cannot be resolved through other means, our attorneys serve as forceful advocates at all levels of civil trial proceedings.

As one of the area's largest law firms, we are able to integrate many aspects of the law in the representation of our clients. Our litigation department consists of highly qualified attorneys who specialize in various aspects of civil litigation. The trial lawyers and legal assistants work together to provide our clients with zealous legal representation. We stress preparedness at all levels of the litigation process, which has resulted in high levels of success.

Four of our attorneys in the civil litigation department are Board Certified, two specializing in Civil Trial Law and two specializing in Business Litigation Law.

Each attorney in our litigation practice has one or more areas of special expertise, providing our clients with a complete range of commercial and civil representation. Major areas include commercial litigation, real estate litigation, shareholder and partnership disputes, contracts, probate litigation, personal injury litigation, mortgage and mechanic's lien foreclosures, construction defects litigation, anti-trust cases, defamation cases, zoning and land use matters, consumer fraud claims, and collections. The firm also represents parties involved in complex family law litigation, including child custody issues and the valuation of professional practices and business holdings.

Recognizing that many cases do not fall into convenient categories, our litigation team works closely with practitioners from other departments within the firm, especially in complex areas such as condominium law, tax law, and probate law. By utilizing all available resources, our litigation department is able to advise clients not only on the substantive issues at stake, but also the procedural strategy to pursue. In many cases, the firm is willing to review and evaluate clients' needs and handle matters on a contingent fee basis.

Construction Defects Litigation
Our attorneys have substantial experience representing owners, contractors and subcontractors in construction defects litigation, including cases involving condominium, residential and commercial construction.

Collections
The litigation department represents individuals, businesses and financial institutions through all phases of the collection process for pre-suit legal advice, through filing suit and trial, and the enforcement of judgments rendered in those cases.

Contract Disputes
We draw from a broad range of expertise, which allows us to represent clients in all aspects of contract disputes. For instance, our attorneys represent clients regarding insurance coverage litigation, real estate litigation, complex land sale disputes, enforcement of promissory notes and mortgages, and partnership and shareholder disputes.

Employment Disputes
Our attorneys represent employers and employees in suits involving sexual harassment and employment discrimination, as well as disputes regarding employment agreements and contracts.

Estate Disputes
We are involved on a regular basis in handling disputes concerning estates. These cases involve the interpretation of wills and the relative rights of persons under the terms of those documents, including family members and third parties. In these situations, the litigation department works closely with the estate planning and probate departments on behalf of our clients.

Personal Injury, Product Liability, Insurance Disputes
Our trial practice also includes representing plaintiffs in personal injury suits. We handle cases involving wrongful death, negligence claims, product liability, professional malpractice and actions against insurance companies to require coverage for the client. We also defend clients in personal liability matters.

Alternative Dispute Resolution
Fox Wackeen recognizes the beneficial aspects of Alternative Dispute Resolution (ADR), including mediation and arbitration, in providing a more cost-effective solution to disputes and minimizing costly and lengthy litigation. We actively point out to clients the advantages of the ADR process. The firm has several attorneys who are Florida Supreme Court and Federal Court Certified Mediators and Arbitrators, who are authorized to serve as the neutral third party to help adverse parties seek a voluntary resolution of their disputes.
